{"id":15692,"date":"2020-07-15T11:23:01","date_gmt":"2020-07-15T15:23:01","guid":{"rendered":"http:\/\/irishexaminerusa.com\/wp\/?p=15692"},"modified":"2020-07-16T07:24:10","modified_gmt":"2020-07-16T11:24:10","slug":"ian-bailey-appears-at-high-court-in-dublin-to-fight-extradiction","status":"publish","type":"post","link":"https:\/\/irishexaminerusa.com\/wp\/?p=15692","title":{"rendered":"Ian Bailey Appears At High Court In Dublin To Fight Extradiction"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"http:\/\/irishexaminerusa.com\/wp\/wp-content\/uploads\/2020\/07\/2.54587781.jpg\" alt=\"\" width=\"600\" height=\"338\" class=\"aligncenter size-full wp-image-15693\" srcset=\"https:\/\/irishexaminerusa.com\/wp\/wp-content\/uploads\/2020\/07\/2.54587781.jpg 600w, https:\/\/irishexaminerusa.com\/wp\/wp-content\/uploads\/2020\/07\/2.54587781-300x169.jpg 300w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/>A former journalist has appeared before the High Court in Dublin as he fights his extradition to France over the murder of Sophie Toscan du Plantier.<\/p>\n<p>Ian Bailey, 63, was arrested last year after a High Court judge endorsed a European Arrest Warrant issued by the French authorities.<\/p>\n<p>He is wanted in France for the murder of Ms Toscan du Plantier, who died in Schull, Co Cork, in December 1996.<\/p>\n<p>Mr Bailey\u2019s lawyer Ronan Munro said he has a \u201cvested\u201d or absolute right not to be surrendered to the French authorities following his conviction, in his absence, for the murder of Ms Toscan du Plantier.<\/p>\n<p>Mr Bailey \u2013 who appeared in court wearing a navy suit and a green scarf as a face covering \u2013 did not speak as he listened from the back of the courtroom.<\/p>\n<p>Mr Munro insisted that Mr Bailey has an \u201ciron-clad\u201d and \u201cunassailable\u201d right not to be surrendered to the French authorities as two previous extradition attempts by them had been struck down by Irish courts.<\/p>\n<p>\u201cThe central submission is that there is a binding judgment of the Supreme Court that prohibits the surrender of Ian Bailey,\u201d said Mr Munro.<\/p>\n<p>\u201cIn Mr Bailey\u2019s case there was a final judgment in 2012 \u2013 and if that wasn\u2019t enough, there was another judgment in the High Court in 2017.<\/p>\n<p>\u201cHe has an unassailable right not to be surrendered in this sense,\u201d he added.<\/p>\n<p>Mr Munro said the Irish Supreme Court finding that Mr Bailey could not be extradited was \u201cvested\u201d by his client.<\/p>\n<p>He said the attempt by the French authorities to extradite Mr Bailey for a third time could amount to \u201can abuse of process\u201d.<\/p>\n<p>\u201cWhere there a third set of proceedings, I say prima facie that it is indicative of an abuse of process. I don\u2019t think it is controversial to say that.<\/p>\n<p>\u201cThere have been cases of three warrants being issued unknown to the person being surrendered, but in general in criminal proceedings, if you\u2019re going to do it a third time then there would want to be a good reason,\u201d Mr Munro said.<\/p>\n<p>\u201cIf we\u2019re looking at a third attempt to have him prosecuted then the court must apply a very high level of scrutiny and this may be indicative that the process is being abused.<\/p>\n<p>\u201cThe very fact of a third set of proceedings is indicative that an abuse of process is taking place.\u201d<\/p>\n<p>Mr Munro said the extradition attempt is a breach of Mr Bailey\u2019s human rights, as was the delay in the trial and the fairness of the trial that may await in France.<\/p>\n<p>He read out a written statement from Mr Bailey in which he maintained he \u201chad nothing to do with\u201d the murder of Ms Toscan du Plantier.<\/p>\n<p>In the affidavit, Mr Bailey said he could not pursue his career as a journalist due to the negative media coverage he has received and his ongoing legal battle.<\/p>\n<p>Mr Bailey said his mental health has suffered in the 23 years since Ms Toscan du Plantier died.<\/p>\n<p>The court was told that as he cannot work as a journalist, he is in receipt of social welfare, which he tops up by selling poetry and doing casual odd jobs.<\/p>\n<p>Mr Bailey said he suffers from depressive moods and a skin condition brought on by the stress of all the court cases.<\/p>\n<p>He has a law degree from University College Cork and wanted to attend the King\u2019s Inns in Dublin to pursue his legal studies further but has been prevented from doing so due to the ongoing legal cases.<\/p>\n<p>Mr Bailey said he found writing poetry has had a cathartic effect, as counselling has proved unsuccessful for him, and he has published two collections of poetry.<\/p>\n<p>He said he wrote a poem called \u201cNightmare\u201d which has summed up his experiences to date.<\/p>\n<p>The former journalist suffers from nightmares and sleep disorders due to flashbacks from his previous arrests.<\/p>\n<p>He said that since 2010, his European Arrest Warrant means he has been unable to travel freely.<\/p>\n<p>Mr Bailey could not visit his elderly mother in the UK when she was dying and said the fact that he could not attend her funeral \u201cwas one of the cruelest aspects of the whole process\u201d.<\/p>\n<p>He said while he has attempted to live a normal life, with legal proceedings starting again, his standing has been lowered significantly in the eyes of the small west Cork community he lives in.<\/p>\n<p>Mr Bailey\u2019s solicitor Frank Buttimer said in an affidavit to the court that the French authorities had not communicated with him or his office to get Mr Bailey to attend the trial.<\/p>\n<p>This, Mr Munro noted, was \u201cvery strange\u201d.<\/p>\n<p>The case continues this afternoon.<\/p>\n<div class=\"sharedaddy sd-sharing-enabled\"><div class=\"robots-nocontent sd-block sd-social sd-social-icon sd-sharing\"><h3 class=\"sd-title\">Share this:<\/h3><div class=\"sd-content\"><ul><li class=\"share-facebook\"><a rel=\"nofollow\" data-shared=\"sharing-facebook-15692\" class=\"share-facebook sd-button share-icon no-text\" href=\"https:\/\/irishexaminerusa.com\/wp\/?p=15692&amp;share=facebook\" target=\"_blank\" title=\"Click to share on Facebook\"><span><\/span><span class=\"sharing-screen-reader-text\">Click to share on Facebook (Opens in new window)<\/span><\/a><\/li><li class=\"share-twitter\"><a rel=\"nofollow\" data-shared=\"sharing-twitter-15692\" class=\"share-twitter sd-button share-icon no-text\" href=\"https:\/\/irishexaminerusa.com\/wp\/?p=15692&amp;share=twitter\" target=\"_blank\" title=\"Click to share on Twitter\"><span><\/span><span class=\"sharing-screen-reader-text\">Click to share on Twitter (Opens in new window)<\/span><\/a><\/li><li class=\"share-google-plus-1\"><a rel=\"nofollow\" data-shared=\"sharing-google-15692\" class=\"share-google-plus-1 sd-button share-icon no-text\" href=\"https:\/\/irishexaminerusa.com\/wp\/?p=15692&amp;share=google-plus-1\" target=\"_blank\" title=\"Click to share on Google+\"><span><\/span><span class=\"sharing-screen-reader-text\">Click to share on Google+ (Opens in new window)<\/span><\/a><\/li><li class=\"share-print\"><a rel=\"nofollow\" data-shared=\"\" class=\"share-print sd-button share-icon no-text\" href=\"https:\/\/irishexaminerusa.com\/wp\/?p=15692\" target=\"_blank\" title=\"Click to print\"><span><\/span><span class=\"sharing-screen-reader-text\">Click to print (Opens in new window)<\/span><\/a><\/li><li class=\"share-end\"><\/li><\/ul><\/div><\/div><\/div>","protected":false},"excerpt":{"rendered":"<p>A former journalist has appeared before the High Court in Dublin as he fights his extradition to France over the murder of Sophie Toscan du Plantier.
