Stone killed three people in a gun and grenade attack at Milltown Cemetery in west Belfast following an IRA funeral.<\/p>\n
He was freed under the Good Friday Agreement in 2000, but was returned to prison six years later for trying to kill then Sinn F\u00e9in leaders Gerry Adams and Martin McGuinness at Stormont.<\/p>\n
Last year Stone was ordered by the High Court in Belfast to serve a further five-and-a-half years before he can be considered for release.<\/p>\n
An appeal against that ruling was taken to Britain’s Supreme Court.<\/p>\n
A statement from the court said: \u201cThe Supreme Court unanimously holds that the present proceedings do not constitute \u2018a criminal cause or matter\u2019, with the result that the court does not have jurisdiction to consider the appeals.\u201d<\/p>\n
High Court judges last year said Stormont\u2019s Justice Department had wrongly determined Stone would be eligible to seek parole.<\/p>\n
They said a six-year period spent out on licence before the murder attempt at Stormont should not count towards his 30-year minimum term.<\/p>\n
Supreme Court judge Lord Sales said: \u201cThe issue raised in the present case does not relate to the commencement or conduct of any underlying criminal process involving Mr Stone.<\/p>\n
\u201cHe is not subject to any outstanding undetermined criminal charge on which he will be tried and may be subjected to sentence.<\/p>\n
\u201cThe present proceedings are concerned with whether his past criminal sentence has been correctly understood and implemented.<\/p>\n
\u201cThe High Court decision was therefore not in \u2018a criminal cause or matter\u2019 and the relevant right of appeal is to the Court of Appeal, not the Supreme Court.<\/p>\n
\u201cAs a result, and because the Supreme Court is likely to be assisted by consideration by the Northern Ireland Court of Appeal on the operation of the 1998 Act, should the case return for consideration, the Supreme Court does not think it appropriate to say anything about the merits of the appeals.\u201d<\/p>\n
Stone, a former Ulster Defense Association (UDA) member, was found guilty of three other killings in the North in addition to Milltown.<\/p>\n
They included murdering a milkman, shooting a joiner in the head and firing at another man up to 16 times with a submachine gun.<\/p>\n
